bbBinge — Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and TDBA, LLC ("bbBinge," "we," "us," or "our"), a Florida limited liability company located at 3712 W. Wisconsin Ave., Unit 105, Tampa, FL 33611. They govern your use of bbbinge.com, the bbBinge game, and the bbBinge membership (together, the "Service").

Please read Section 2 (billing and auto-renewal) and Section 10 (disclaimers and limits) carefully — they affect your money and your legal rights.

By checking the box that says you agree to these Terms, creating an account, or making a payment, you accept these Terms and our Privacy Policy and Refund Policy. If you do not agree, do not use the Service.

1. Who can have an account

Where bbBinge is available. bbBinge is sold in the fifty United States. We cannot currently accept customers with a Washington, D.C. billing address — D.C. has its own subscription-notice rules that we have not yet built for, and we would rather decline than serve you under terms we cannot meet. If you sign up with a D.C. billing address we will cancel it and refund anything charged, in full.

You must be 18 years of age or older to create an account and to enter a payment method. bbBinge is built for basketball families, and children are welcome to play — but a child plays on the account of their parent or legal guardian, with that adult's permission and supervision. The adult who owns the account is responsible for everything done on it, including a child's use.

Because accounts belong to adults, the rule elsewhere in these Terms against using "another person's account" does not stop a parent or guardian from letting their own child play on the adult's own account. It means you may not use an account that belongs to someone who has not authorized you.

We do not knowingly let anyone under 18 create their own account, and we do not knowingly collect personal information from a child except as described in the "Children" section of our Privacy Policy. If you believe a child has created an account on their own, email [email protected] and we will close it and delete the information attached to it.

2. Your membership, billing, and automatic renewal

This is the part that costs money. Please read it twice.

The plan you choose, the exact price, the billing frequency, the length of any free period, and the exact calendar date of your first charge are shown to you on the checkout screen before you enter a card, and again in the receipt we email you.

Your consent to be charged

When you start a paid plan you give us a card and separately confirm that you agree to the automatic renewal on the terms above. We keep a record of that consent — the plan, the price, the first-charge date, the exact wording you agreed to, and the version of these Terms in effect — for at least three years, or one year after the membership ends, whichever is longer.

The reminders we send you

If the price ever changes

If we change the price of your plan, we will tell you at least 14 days and no more than 30 days before the change, in a message you can keep that includes a cancellation link, and we will not charge the new, higher price without your agreement. You can cancel before the new price applies.

Cancelling

You can cancel any time, in one click, from your account — no phone call, no email, and nobody trying to talk you out of it. If you signed up but cannot sign in, email [email protected] and we will cancel for you. When you cancel, you are not charged again, and you keep access until the end of the period you have already paid for. If you cancel during a free period, you are never charged at all.

Taxes, failed payments, and authorization

Prices are in U.S. dollars and do not include any tax that may apply; where tax applies it is added at checkout. You authorize us and our payment processor to charge your card for the amounts and on the schedule described above and shown at checkout. If a charge fails, we may retry it and let you know; if it keeps failing, your paid features may pause or your plan may end until payment succeeds.

3. Coins, points, and prizes are not money

Quarters, coins, points, tokens, streaks, ranks, and prizes inside bbBinge are parts of a game. They have no cash value. You cannot buy them, sell them, cash them out, or exchange them for money or for anything outside the game, and we cannot pay them out. On-screen items such as novelty "prizes" are game graphics only and are never redeemable for a real item or for money.

Nothing in bbBinge is gambling, and no part of the Service lets you wager money. Your quarters and coins come from playing, never from a purchase, and no purchase improves your chances in any game. If your account ends for any reason, anything accumulated inside the game ends with it and is not refundable or transferable.

4. Competitions, opponents, and leaderboards

6. Our content and intellectual property

The Service — including the games, the software, the question sets, the coaching answers, the text, graphics, look and feel, and the way it is all put together — is owned by TDBA, LLC or its licensors and is protected by copyright and other laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial enjoyment while your account is in good standing. You get no other rights.

Our questions are based on factual records about basketball. While facts themselves are not owned by anyone, our particular selection, wording, and arrangement of them is ours, and you may not copy or reuse it.

"bbBinge," our logos, and our taglines are our trademarks. Other names — including the NBA, WNBA, NCAA, any team, any league, and any player — are the trademarks of their respective owners, used only to state facts about them. bbBinge is not affiliated with, endorsed by, or sponsored by any of them.

7. Changes to the Service

bbBinge is actively being built. Games, formats, questions, and features will change, and some will be retired. We will not remove a paid feature you are currently paying for without telling you and giving you the chance to cancel first.

8. Ending your membership or account

You can cancel any time from your account, and you can ask us to delete your account entirely (see the Privacy Policy).

We may suspend or end your access if we stop operating the Service, if the law requires it, or if you materially break these Terms in a way we reasonably and in good faith determine is deliberate or harmful (for example, cheating the paywall, scraping our content, or abusing other players). If we close a paid account for that kind of material breach, we are not required to refund the remaining period. We will not use this as a way to avoid a refund you are otherwise owed. If we stop operating bbBinge entirely, we will refund any period you have paid for and not received. Refund details are in the Refund Policy.

9. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be uninterrupted, error-free, or that any particular game, question, or competition will always be available.

10. Limitation of liability

To the fullest extent permitted by law, TDBA, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or data. Our total liability to you for any claim connected with the Service is limited to the amount you paid us in the twelve months before the claim (or, if you paid us nothing, one hundred U.S. dollars).

Nothing in these Terms limits any liability that cannot legally be limited, including liability for fraud, for personal injury caused by our negligence, or any rights you have as a consumer that cannot be waived under the law of the place you live.

11. Governing law and where disputes are handled

These Terms are governed by the laws of the State of Florida, and any dispute will be handled in the state or federal courts located in Florida — except that this does not take away any right or protection you have under the consumer-protection law of your own home state or country that cannot be waived by agreement. If any part of these Terms is unenforceable, the rest still applies.

12. Changes to these Terms

If we change these Terms in a way that matters, we will post the new version here and update the date at the top, and for significant changes we will tell you by email. If a change affects your paid plan, we will give you the chance to cancel before it takes effect.
